The New Way to Mediate, Arbitrate and Settle Disputes! The same system used in required pre-trial mediation in the 2nd, 4th, 6th, 7th and 11th Circuits in the U.S. Court of Appeals. HERE IS AN EXAMPLE MEDIATION: To better understand how it works let's use the details of a fictitious mediation between Mr. Smith (plaintiff) and Mr. Jones (defendant). Both parties have decided on Mr. Dow as the mediator. Cast of Characters: Plaintiff: Mr. Smith in Miami Plaintiff Attorney: Mr. Mark in Miami Defendant: Mr. Jones in Houston Defendant's Attorney: Mr. Rich in Houston Mediator: Mr. Dow in New York City In this example our five (5) participants are in three different cities. However, with "Mediation in the Clouds" you have a choice. For example, all five (5) of our characters can each be in different cities or in different countries!. All scheduling is done by our staff and each party receives a confirming email as to date and time. The mediation is scheduled for Monday morning starting at 9:45 EST. On the previous Friday, all parties uploaded to the mediator all pertinent documentation. These included opening statements, pleadings, financial documents, etc. which were reviewed by the mediator. The mediator has already sent to each party agreements and acknowledgements, which must be signed prior to the mediation.
