About Office of the Commissioner for Standards in Public Life - Malta
The role of the Commissioner for Standards in Public Life is defined by the Standards in Public Life Act (chapter 570 of the laws of Malta). The Act empowers the Commissioner to look into the behaviour of members of Parliament, including ministers, and persons of trust – that is to say persons who are engaged on trust from outside the public administration to serve as consultants or staff in the secretariats of ministers or parliamentary secretaries, or to fill posts in the public administration that remain vacant following repeated calls for applications. The Commissioner can consider whether ministers and other members of Parliament have broken the law, failed to comply with any ethical or other duty set out by law, or abused their powers. The Commissioner can consider whether persons of trust have failed to abide by their ethical obligations. The Commissioner can open an investigation on his own initiative or on the basis of a complaint. In addition to considering such cases, the Commissioner can examine the declarations of assets and interests made by members of Parliament and ministers in terms of the relevant code of ethics. The Commissioner can also make recommendations for the improvement of the codes of ethics applying to ministers, members of Parliament and persons of trust, and for the better regulation of related matters such as lobbying and the acceptance of gifts. The Commissioner has presented proposals on such matters.
